Terms of Service

Conditions governing the use of a.b.g.n.o. logistics services and digital platforms.

Scope of Services

a.b.g.n.o. provides freight logistics and supply chain optimization services to commercial clients within Canada and across international borders. All services are subject to the Canada Motor Vehicle Transport Act and applicable provincial regulations.

The company acts as a logistics intermediary and carrier coordinator. Specific service parameters, including transit times, liability limits, and pricing, are defined in individual service agreements executed between a.b.g.n.o. and the client.

Client Responsibilities

The client is responsible for providing accurate and complete shipment information, including cargo description, weight, dimensions, and any hazardous material classifications. Failure to disclose accurate information may result in service refusal or additional charges.

The client must ensure that all cargo complies with applicable laws and regulations, including the Transportation of Dangerous Goods Act and the Canada Motor Vehicle Transport Act. The client indemnifies a.b.g.n.o. against any claims arising from non-compliant shipments.

  • Provide accurate shipping documentation at least 24 hours before pickup.
  • Ensure cargo is properly packaged and labeled according to regulatory standards.
  • Maintain valid insurance coverage for cargo value exceeding standard liability limits.

Limitation of Liability

a.b.g.n.o.'s liability for loss, damage, or delay of cargo is limited to the terms specified in the applicable service agreement and in accordance with the Canada Motor Vehicle Transport Act. In no event shall a.b.g.n.o. be liable for consequential, incidental, or indirect damages.

The company does not assume liability for delays caused by weather, border inspections, mechanical failures, or other events outside its reasonable control. Clients may purchase additional liability coverage at the time of booking.

Claims Procedure

Claims for loss or damage must be submitted in writing within 30 days of delivery or scheduled delivery date. Claims must include supporting documentation, including photographs, inspection reports, and original shipping documents.

a.b.g.n.o. will review claims within 15 business days and respond with a determination. Disputed claims may be subject to mediation or arbitration as outlined in the service agreement.

Service Modifications and Termination

Either party may terminate a service agreement with 30 days written notice. a.b.g.n.o. reserves the right to suspend services immediately if the client violates any term of this agreement or applicable law.

Service modifications, including changes to routes, schedules, or cargo specifications, must be requested in writing and confirmed by a.b.g.n.o. at least 48 hours before the scheduled service date. Additional charges may apply for modifications.

  • Termination notice must be sent to info@abloodygreatnightout.com.
  • Upon termination, outstanding fees become immediately due and payable.
  • a.b.g.n.o. will return any client property within 30 days of termination.

Dispute Resolution

Any dispute arising from these terms or related services shall first be resolved through direct negotiation between the parties. If negotiation fails, the dispute shall be submitted to mediation in accordance with the laws of the province of Ontario.

If mediation does not resolve the dispute, the matter shall be settled by binding arbitration under the Arbitration Act. The arbitration shall take place in Toronto, Ontario, and the decision of the arbitrator shall be final and binding.

Changes to Terms

a.b.g.n.o. reserves the right to modify these terms at any time. Clients will be notified of material changes via email at least 30 days before the changes take effect. Continued use of services after the effective date constitutes acceptance of the modified terms.
